Expert Catastrophic Injury Lawyers to Represent You in Wabamun, AB

A catastrophic injury is a severe injury to the spine, spinal cord, or brain, and might include skull or spinal fractures. Generally, a catastrophic injury is classified based on three outcomes – fatality, causing permanent severe functional disability, and those causing severe head or neck trauma with no permanent disability. Under such circumstances, a catastrophic injury lawyer in Wabamun, Alberta, has to be hired. The law in such cases is quite complicated, and the insurance company might refuse to settle based on good faith.

The primary goal of a catastrophic injury attorney is to put the injured at the same level of the physical and mental level that he/she was before the accident. In many cases, though, this is not possible as the person might have received irreversible brain injury or spinal cord injury. If this is the case, the goal of a catastrophic injury lawyer will change to put the injured as “close a position” as possible to where the individual was before the injury. It relates to the same financial position if the accident not happened.

The need for a lawyer to arrive at a settlement with the fair compensation that you deserve becomes all the more important when the insurance company refuses to pay or engages in bad faith tactics. If you have been unable to secure a fair settlement offer from the at-fault party’s insurance company on your own or negotiations have broken down, give us a call. We are a leading catastrophic injury lawyer in Wabamun, AB, with long years of experience litigating bad faith catastrophic injury claims.

Factors Analyzed by An Expert Catastrophic Injury Attorney in Wabamun, AB

The clauses in catastrophic injury law in Wabamun, Alberta, is not without complexities and intricacies, and settlement of catastrophic injury claims is not a straightforward matter. You can have a claim against a negligent party only if you can prove in a court of law that he/she was solely liable and responsible for the accident. Some instances are where the cause of an accident is a result of several factors involving both the injured and the defendant. For example, if you have been injured in a motor vehicle accident and was not wearing a seat belt at the time of the accident, the quantum of compensation might be reduced if the defendant can show that the severe injuries you sustained were because of not wearing the seat belt. It is typically known as “contributory negligence.”

It is always our goal as a trusted catastrophic injury attorney to resolve your claim through the normal negotiating process. The settlement of a claim is quick, and you save a lot in court expenses and charges. If that fails, we go to trial as you have the right to have the matter decided by a judge (or judge and jury). We resolve catastrophic injury claims through the normal negotiating process, and only a small percentage goes to trial under the catastrophic personal injury law in Wabamun, Alberta.

Getting Assessed For LTD Claims By a Long Term Disability Lawyer Near Jarvie, AB

It is not uncommon for insurance companies to deny claims for fair compensation in spite of medical records and data that a patient has not recovered. Often the observations of medical staff are set aside while evaluating long term disability claims. A long term disability lawyer, on the other hand, goes through a detailed assessment process that includes the claimant’s age, education, and work experience. Individuals making LTD claims need the support and representation of lawyers who are experts in defending the claims and getting the deserved compensation. Regardless of whether the policy is under group disability insurance policy or a private policy, the assessments made and presentation of proper evidence is critical. With long years of experience behind us, we understand that such cases rely heavily on getting the necessary medical evidence to show that the policy in question covers the disability.

During the assessment of a disability claim, several issues are connected with filing an appeal on time and the preparation and presentation of proper evidence. Many long-term disability insurance policies in Jarvie, Alberta, have certain time limits that are very challenging to follow. As soon as your disability benefits are denied and ideally before you initiate the application, you should consult a long term disability lawyer near Jarvie.

Considering that the waiting periods can range anywhere from 30 to 90 days, you must contact a long term disability lawyer immediately. To highlight all elements in your case, and present the evidence credibly, take the help of an experienced lawyer. Only then can you enhance the chance of recovering the compensation that you deserve.

The Need to Hire Drunk Driving Accident Lawyer in Starland, AB

Impaired driving is a term used in Canada to denote driving while under the influence of drugs/alcohol. It includes Driving over the Legal Limit, Refusal to Provide a Breath Sample, Failure to Provide a Breath Sample, and loss of Care and Control While Impaired. The standard terms for similar cases in the USA are Driving Under Influence (DUI) or Driving While Intoxicated (DWI). If you or one of your loved ones is involved in an accident where the driver was impaired due to drugs or alcohol or both, you should immediately contact reputed drunk driving accident attorneys in Starland, Alberta, to represent you at trial. They will help to file claims of compensation.

Under the new laws in Starland, impaired driving have recently been toughened with disastrous consequences for the driver if proved guilty. Under the new regulations, blood alcohol levels of over 0.08 (or “over 0.80”) will lead to criminal charges. Blood alcohol levels over 0.05 will result in immediate license suspension and vehicle seizures. In some provinces, it is 0.04. You have a very fair chance of getting adequate compensation in an accident where impaired driving is the cause. But this will be possible if well-known DUI accident attorneys with years of experience in personal injury laws represent you in Starland, Alberta.

As experienced DUI accident attorneys in Starland, Alberta, there are many aspects that we focus on when our client is injured in a drunken-driving accident. We understand that it is not only alcohol that falls under the ambit of impaired driving. The use of illegal, prescription or over-the-counter drugs also can lead to driving under influence charges too. Our focus is if drugs or alcohol affected the judgment and ability of the driver. We also evaluate whether it stopped the driver from accurately perceiving and reacting to what was happening on the road when the accident occurred, leading to your injuries. Being competent drunk driving accident lawyer in Starland, AB, we will work out a strategy to get the maximum claims settlement.

Investigations by Drunk Driving Accident Attorneys in Starland, Alberta

After an accident involving a drunk driver, DUI accident attorneys in Starland, Alberta carry out thorough investigations into the charges as many elements have to be proved beyond a reasonable doubt. We should know if the driver operated or had the care and control of a motor vehicle when his/her ability to operate it was weak because of alcohol or a drug.

The scope of the offense includes apart from motor vehicles, electric scooters, electric bicycles, and even hover-boards. The definition of a motor vehicle is not just cars, but anything that is driven by a motor or is electrically powered. Also though 99% of the cases we deal with relate to the involvement of a motor vehicle, technically, the law applies to any “conveyance,” including a boat, railway equipment, or airplane.

When investigating the case, our team of DUI accident attorneys in Starland, AB, focuses on specific charges that judges too consider as evidence. Broadly, these include the smell of alcohol in the breath of the driver and the pattern of speech. Other factors are balance while standing or walking, hand/eye coordination, and any admission made to the police either in transport, in between giving breath samples, or before the driver was released.

As reputed truck accident attorneys, we understand the industry rules, regulations, and conventional protocols thoroughly. There are several factors to determine the liability of a truck driver in the event of an accident. These help in the preparation of claims. When our truck accident law firm represents the family of the victim who has been killed in a fatal truck accident or has received injuries so severe that they are irreversible, we fight to get the family compensated adequately. This includes loss of income, treatment bills, and emotional and psychological pain and suffering.

There are other aspects of our investigation that we being well-known truck crash lawyers in Bow Island, Alberta, look into as part of our investigation. We gather all records and documents about the driver’s commercial license status, maintenance manifests, hours driven in a specific period, and completion of drug tests. All these together enable us to determine whether the driver was negligent in causing the accident. We also investigate whether there were other reasons besides the driver that was liable for the truck accident injury.

Points Analyzed by Truck Accident Attorneys in Bow Island, AB for Maximum Claim Settlements

There is a difference in severity in a truck accident with a passenger car and that of two cars only. Due to the enormous difference in size between a truck and a passenger vehicle, the latter often gets horrifically battered in a tangle with a truck, leading to catastrophic injuries for the occupants. The chances of serious injuries in an accident between a truck and a car are always high.

Semis, commercial trucks, tractor-trailers are a great deal bigger than passenger cars and it is usual for the truck drivers to be far less affected in an accident than those in a car. If you are a victim of such an accident, get in touch with truck accident attorneys in Bow Island, AB, who can ably prepare claim settlement papers for you.

Several points are analyzed by us when our truck accident law firm in Bow Island, Alberta, takes up a case on behalf of truck accident victims. The negligence factor is always the focus of our investigations. A truck driver involved in an accident might have been under the influence of drugs or alcohol, texting while driving, or running a red light and causing an accident.

Other instances have come to our notice too. Some examples that are the cause of accidents are truck drivers who are very tired but still driving and companies enforcing unreasonable schedules. Poorly maintained trucks, trucks with defects needing repairs, trucks with overloaded cargo, and accidents resulting from poorly maintained roads are some of the common reasons for truck accidents. It is the critical responsibility of truck crash lawyers in Bow Island, Alberta, to precisely arrive at the cause of the accident so that a real case can be prepared for negotiation or trial.

Requesting a Calculation of Claims by a Truck Injury Attorney in Bow Island

Several factors are taken into account when the quantum of claims has to be arrived at. There are many tangible and intangible angles to it, and only an experienced truck injury lawyer in Bow Island can arrive at a fair amount.

We first take into account the costs of medical treatments and rehabilitation, both present and long term. Included are the costs of ongoing treatments and therapies and the future use of mobility aids like wheelchairs. Most of these are tangible costs that are measurable.

A truck accident law firm in Bow Island, Alberta, will also consider the intangible expenses which comprise of future loss in income and job opportunities. To arrive at a close estimate, we avail of the services of experts in the field, like medical practitioners, occupational therapists, functional capacity experts, and cost of care assessors. Chartered accountants are also brought on board. It is to estimate the approximate amounts of future job income losses, job opportunities, and the overall economic effect on the life of the victim due to the accident.

The Importance Of Contacting A Truck Accident Law Firm in Bow Island Immediately Following An Accident

After an accident, you should contact a truck accident law firm at the earliest. Any delay can lead to crucial evidence being lost. Further, most claim amounts received are substantial. Hence, the negligent party will try to contest the claim so that the payout is reduced. Therefore, with truck accident attorneys in Bow Island with you, it is possible to present your case robustly.

There is another essential aspect to it. There is a limitation law in Bow Island, Alberta. It stipulates that all claims have to be submitted within two years from the date that you knew or should have known that you will make a claim. In some cases, this limitation period is calculated in months. If you do not file a claim within that period, the right to file a claim will be lost.

Pedestrian Accident Law Firm in St. Albert, Alberta

pedestrian accident attorney St. Albert 1

Due to the time sensitive and technical nature of a pedestrian hit by car compensation and the collection of evidence, it is strongly recommended that you get in contact with an experienced St. Albert immediately.

The Need for Pedestrian Accident Attorney in St. Albert, AB

According to St. Albert Transportation and despite the dangers for pedestrians on St. Albert roads, pedestrian accidents make up only 6.4% of all injuries. But the bad news is that 13.6% lead to fatalities. Pedestrians face the brunt of the size, weight, and speed of cars, and this is what leads to fatalities. Even if a pedestrian survives an accident, the injuries can be very severe. Lucky is the pedestrian who gets away with minor bruises and cuts. The overall outcomes are skull or limb fractures and spinal cord and brain damage that can lead to the victim being a wheelchair user for life. The fault is not one-sided, though. While drivers must drive carefully and watch out for pedestrians, people on the road should be alert too about the surroundings.

The point here is, why would you need a pedestrian accident attorney in St. Albert, Alberta? Investigations Carried Out by a Pedestrian Accident Lawyer in St. Albert, Alberta

Pedestrian safety is a mutual responsibility. Pedestrians should not think that they have the right of way, and cars and motor vehicles should yield to them. Drivers, too, should drive safely and with due caution. It is our responsibility as a pedestrian accident lawyer in St. Albert, Alberta, to carry out detailed investigations before filing pedestrian accident claims on behalf of the victim of a pedestrian motor vehicle accident.

There are several critical factors that we take into account while working out pedestrian hit by car compensation. These include whether the driver was distracted (texting, talking on the cell phone, or something similar), speeding, disregarding weather or traffic conditions, and traffic signals or signs. Other aspects for arriving at pedestrian accident claims are driver’s failure to yield the right of way at marked crosswalks and intersections, inability to come to a complete stop at a stop sign, and failure to stop before turning right on red at a crossing.

However, pedestrians also have to be proactive about their safety and be alert on the roads to traffic.

There are several areas that we explore as a trusted personal accident law firm in St. Albert, Alberta, for calculating pedestrian accident claims. These include past and future lost wages, costs of medical treatment and physical therapy, out of pocket expenses, loss of ability to do household chores and pain and suffering.

Ancillary costs are no less important. Evidence Required For a Pedestrian Hit by Car Compensation Case in St. Albert

For a pedestrian who is a victim of a car accident, the complicated process for submission of pedestrian accident claims compounds the stress, physical, and mental suffering. People are so overwhelmed by the process of recovery and treatments that the focus is hardly ever on the act of filing of a pedestrian hit by car compensation in St. Albert, Alberta. For the ordinary person, it is also not possible to know the rights. Hence, it is easy to get buried under the system of complex laws and confusing paperwork. Hence, there is a further delay in the receipt of compensation for medical treatments and rehabilitation.

It is here that a pedestrian accident lawyer in St. Albert, Alberta, has a crucial role to play. Evidence is the key to a successful trial, and you can help your pedestrian accident attorney with enough critical evidence to fight your case diligently. A few steps should be taken by you as soon as possible after receiving medical treatment.

The first is to get contact particulars and the insurance information of the parties involved in the accident. Get contact details of the people who were at the site of the accident so that they may be made potential witnesses at trial. However, never negotiate with an insurance company for a pedestrian hit by car compensation alone without an experienced representative of a pedestrian accident law firm in St. Albert, Alberta, beside you if you have to get a fair deal. Next, contact the police, file a report, and keep at least two copies with you for records. Finally, take photographs of the accident site, your injuries, road conditions, condition of the tires of the vehicle that hit you as well as the precise location.

All these will help at trial in getting the most deserving pedestrian accident claims settlement.

Contributory Negligence in Pedestrian Accident Claims in St. Albert, Alberta

Under St. Albert’s Traffic Safety Act, in the event of a collision between a motor vehicle and a pedestrian, the driver will usually be found 100% liable for the accident. It is unless the driver can prove that there was nothing that a reasonable driver could have done to prevent the accident. This scenario is called contributory negligence, where the pedestrian is partially at fault too. In such cases, the court reduces the quantum of a pedestrian hit by car compensation by as much as 50%.

To get the best deal it is therefore recommended that you get in touch with a pedestrian accident attorney in St. Albert, Alberta at the earliest after an accident.

spinal cord injuries attorney Lamoureux 1

Due to the time sensitive and technical nature of spinal cord injury settlements and the collection of evidence, it is strongly recommended that you get in contact with an experienced immediately.

Experienced and Trusted Spinal Cord Injuries Attorney in Lamoureux, AB

One of the worst forms of disability is being paralytic and being in a wheelchair for life. Some people are born that way – mainly a genetic disorder at birth. But it is a life-changing situation for the once non-disabled to be in a wheelchair as a result of spinal cord injuries. It may be a result of car or motorcycle accidents or any other similar impact to the head and the spinal cord. These are unexpected accidents, and nobody is prepared for it, least of all the injured and their loved ones. While paralysis is the most common offshoot of spinal cord injuries, others include loss of sensation and non-functioning of limbs and other vital organs.

People with spinal cord injuries have to go through years of rehabilitation not to speak of their loss of income from inability to work. It is the reason why, it is always advisable to contact an experienced and reputed spinal cord injuries attorney in Lamoureux, Alberta as soon as possible. The process of getting a fair and adequate spinal code injury settlement of claims can begin at the earliest. It is critical for rehabilitation and getting life back on rails.

How Our Spinal Cord Injury Lawyers Maximize Compensation Amounts in Lamoureux, Alberta

In case of any accidents leading to severe spinal cord injuries and paralysis, get in touch with spinal cord injury lawyers in Lamoureux, AB, without delay. Lawyers of a spinal cord injury law firm like ours can help you at every step in submitting spinal cord injuries claim. Clients contact us to know more about the spinal cord injury law and what it has for them. We explain the specifics of the process that we follow for claim settlements so that everything is transparent and above board.

Generally, we consider a set pattern in our investigations. We first identify who is to be held liable for the injuries. Then we file a personal injury lawsuit against that party. As an on-going process, we start a thorough investigation so that enough evidence is collated to strongly support our case for a fair spinal cord injury settlement. Our first aim is to arrive at a favorable out-of-court settlement to avoid expenses related to a trial. Only if negotiations fail does the case go for trial.

It is therefore critical that you contact spinal cord injuries lawyer in Lamoureux, Alberta, as soon as possible. Any delay in investigation by us can result in the loss of crucial evidence required for a settlement. Moreover, since these claims are usually of very high value, the negligent party invariably contests the claims made so to reduce the final payout.
